This Terms of Service Agreement (the “Agreement”) governs Your use of socialdata.click (the “Site”) and any services made available to You by SocialData (“we”, “us” or "our"). For purposes of this Agreement, “You” means the person using the Site or the Services or, if You are using the Site or Services on behalf of Your company, then “You” means Your company, its officers, agents, and assigns.

YOUR USE OF THE SITE OR THE SERVICES CONFIRMS YOUR UNCONDITIONAL ACCEPTANCE OF THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THE SITE OR THE SERVICES.

A. Nature of Service and Data Source

SocialData provides a software-as-a-service (SaaS) platform that allows users to access and process publicly available data from various online sources and social platforms. Our service exclusively collects and processes data that is publicly visible and available on the internet. We do not access private profiles, circumvent any privacy settings, or access non-public information. You acknowledge that the data's availability and accuracy are dependent on its public status on the source platform.

B. No Endorsement or Affiliation

SocialData is an independent third-party service. We are not affiliated, associated, authorized, endorsed by, or in any way officially connected with any of the third-party platforms from which data may be accessed. All product and company names, logos, and brands are the registered trademarks of their respective owners. The use of any trade name or trademark is for identification and reference purposes only and does not imply any association with the trademark holder.

C. Prohibited Uses

You may use the Site and the Services only for lawful purposes. You are strictly prohibited from using our service to:

  • Engage in any activity that violates the terms of service of any third-party platform from which data is sourced.
  • Transmit unsolicited commercial messages (Spam), junk mail, or pyramid schemes using the data obtained.
  • Harass, abuse, stalk, threaten, or defame any person or entity.
  • Post or transmit content that is obscene, hateful, or creates a risk to anyone’s privacy or safety.
  • Infringe upon anyone’s intellectual property rights.
  • Attempt to access non-public information or private user accounts.
  • Resell, sublicense, or otherwise distribute the service or data obtained without our express written permission.

D. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of Your account and password and for restricting access to Your computer. You agree to accept responsibility for all activities that occur under Your account. You must provide complete and accurate information during registration and keep this information up-to-date.

You are solely responsible for ensuring that your use of the data obtained through our Services complies with all applicable laws and regulations, including but not limited to GDPR, CCPA, CAN-SPAM Act, and other data privacy and anti-spam laws.

E. Proprietary Rights and License

The Site, its content, code, data, and materials, are protected by international copyright, trademark, and other laws. We grant You a limited, revocable, non-exclusive, non-transferable, personal license to access and use the Services for your personal or internal business use, conditioned on your compliance with this Agreement. You may not copy, modify, distribute, sell, or lease any part of our Services or included software.

F. Disclaimer of Warranties

THE SITE, THE SERVICES, AND THE CONTENT ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS. WE MAKE NO EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WHATSOEVER WITH RESPECT TO THE SITE OR THE SERVICES. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WHILE WE STRIVE FOR HIGH DATA ACCURACY, WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA EXTRACTED.

G. Limitation of Liability

IN NO EVENT WILL SOCIALDATA BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

H. Indemnification

You agree to indemnify and hold harmless SocialData, its affiliates, officers, directors, and employees from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to Your use of the Site and Services, Your violation of this Agreement, or Your violation of any law or the rights of a third party.

I. Changes to the Agreement

We reserve the right to amend this Agreement at any time by posting the amended terms on the Site. Your continued use of the Site or Services after such posting constitutes your acceptance of the amended Agreement.
